[Continuation of yesterday's proceedings.]
Com. vs. Richard Simmons, indicted for maliciously shooting Steven E. Clements with intent to kill; jury and verdict of guilty and penalty fixed at ten years in the penitentiary.
Com. vs. Joseph Lipscombe, charged with assault, convicted and sentenced to pay a fine of $50 and to be confined in jail for three months.
To-day.—A special grand jury was empanelled, with Geo. W. Veitch as foreman, and swore, who returned a bill preferred against Charles Reinneke, for stealing a horse from J. R. Conklin; not a true bill.
The cases of the Com. vs. Dr. James Makall, charged with assault and battery, and same vs. Dr. James Makall, for carrying concealed weapons, were continued for the defendants until next term of court.
The motion to grant Richard Simmons a new trial was argued and the verdict rendered by the jury yesterday set aside, as being too severe, and new trial granted.
