Rail Road Case.
The Albany Evening Journal gives the particulars of an interesting case:
It seems that in May last the Troy cars ran off the track in Saratoga county, by which the engineer was killed, and the fireman badly wounded. A reputable farmer named John Tallmadge, living near the road, was arrested, examined, committed, and subsequently indicted for murder. The trial came on last week, when it turned out that both the principal witnesses had perjured themselves. Judge Wright, on receiving the verdict of the jury, which was of acquittal, congratulated the accused on the complete establishment of his innocence. It seems that one of the witnesses stated that he arrived at Quebec on the 14th of May last, from Limerick: but it was found on inquiry that he arrived there on the 25th of May, the day after the railroad accident. Both the witnesses were arrested for perjury. Mr. Tallmadge was in prison six months, and subjected to an expense of $2000 in preparing his defence. His case is indeed a hard one.
