NEW-YORK, Oct. 26.

On the 16th Thermidor, Louis Nicholas Moline, aged 29 years; Pierre Michel, brigadier general, aged 59; Barthelemy Leveille, chief of brigade, aged 42; Thomas Mondion, chief of brigade, aged 44; Jean Edouard Viand, aged 20; Joseph Pironeau, butcher, aged 22; Toussaint Dustout, aged 44; and Pierre Paul, municipal officer of the commune of the Cape, aged 55; were condemned to death. and the commander in chief of the district ordered to see them diligently executed within the space of 24 hours, in conformity to the 612th article of the penal code, of the 3d Brumaire, year 4, which is couched in these terms:

"All conspiracies and plots tending to disturb the republic by a civil war, in arming the citizens against one another, or against the exercise of the legitimate authority, shall be punished with death, as long as that punishment shall exist, and by twenty-four years imprisonment in irons, after it shall be abolished."

They were condemned by four out of five voices of a court martial, assembled at the Cape, by order of citizen Henry Christophe, chief de brigade, and commander in chief of the district of the Cape.
