For the purpose of giving testimony and presenting the election records contained in his office, Secretary of State Osborn was yesterday served with a subpoena from Navajo county, compelling him to be present in court at Holbrook on March 4th.
It seems that the contest has been filed by the democratic candidate for superior judge in Navajo county against Sidney Sapp the republican candidate who was thought to have been elected, and as all the official records and returns of the last state election have been filed in the office of Secretary Osborn, it is necessary for that official to be present at the trial.
The subpoena signed by W. B. Woods clerk of the court in Navajo county was served on Mr. Osborn yesterday afternoon by Sheriff Jeff Adams of Maricopa county.
According to the wording of the subpoena Secretary Osborn is commanded as follows:
"Bring with you all election returns on file in your office, including poll lists, ballots, tally sheets from each of the Fourteen (14) Election Precincts of Navajo County, Arizona, also the Great Register of said County. All of the aforesaid Election returns and records pertaining to the general election held in said County on the 12th, day of December 1911."
