Yesterday Morning came on to be heard at Doctors Commons a Petition, by Protest, in a Cause brought by an Innkeeper in this City against his Wife for Impotency, after being married thirty two Years. About Seven Years since the Wife brought a Suit against the Husband for a Divorce, by Reason of Adultery, and rather than the Suit should be pronounced the Husband entered into a Bond to allow his Wife eighty Pounds a Year, and agreed not to bring, at any Time hereafter, any Suit against her, on the Forfeiture of two Thousand Pounds. Notwithstanding which the above Suit has been commenced, and the Trustee on the Part of the Wife has commenced a Suit for the two Thousand Pounds. However, the Judge, after having heard Counsel on both Sides, was of Opinion that the Proctor for the Wife must appear absolute, and over-ruled the Protest, though he greatly disapproved the bringing the Cause into Court.
