Custody of his six year old daughter, Rita, was regained late Friday by her father, John Greene, according to Riley Varney, chief field deputy sheriff. The child was allegedly "snatched" from a Sprigg school room Friday morning by her mother, Frances Greene.
A circuit court order, signed by Judge C. W. Ferguson, restraining the mother from leaving Mingo county with the child, was served on her.
In a divorce proceeding several years ago Greene was awarded the children, Rita and her brother. When he returned from service in the Merchant Marine, Greene said he learned his former wife had deserted the children and was living in Colorado, remarrying.
Greene has been caring for the child for two years and has filed a petition to give him legal custody.
Former wife of Greene, who went to the Sprigg school in a taxi, disappeared for some hours and could not be located by deputy sheriffs armed with the restraining order of Judge Ferguson.
After the order was served on her the mother was not detained, Varney said.
