Yesterday John Cagan, Parnell Savage and Matthew O'Neil were tried for the wilful murder of Robert Roby, and acquitted.
Immediately after the above, David was by an order of court, conducted across the bar, to receive sentence of death, for the forgery of which he was convicted therein.
The Rev. Dr. Coombes, Mr. Busby, Mr. Hatcher, Mr. Drury, and Mr. Hayes, attended this unfortunate Divine at the door of the court, from whence he could scarcely advance, on account extreme weakness:--Being asked, at length, if the sentence of death should not be passed upon him. --he read for a few moments, and then addressed the court in the following manner.
My Lord,
"I now stand before you, a dreadful example of human infirmity. I entered upon life with all the flattering prospects of a young man, where birth and education entitle him to hopes for advancement; I taught the truth of the gospel, with the purity of a Christian, and have the happy tie to be. But that by listening to my bad passions I have been preferred from the parsonage to murder been called to repentance -- yet, while I preach virtue to others, I could not save the moment of my own confusion, in which temptation came upon me in full force.
I will not however, presume to importune your compassion, I will not extenuate, by objecting that I did not intend to defraud. I have fallen from affluence and reputation to extreme poverty and contempt of name fill called in the public streets, the sponge of the thoughtless and inhuman." it may however, appear strange, that amidst this accumulated misery, I still wish to live. I wish to atone for the criminality of my transgression by exemplary repentance. I do not mingle with the base expectations,--to not fear the approach of death, insomuch that I dread the thoughts of a violent death, and I wish to work for the rc Al Christian I have brought upon, the Clergy, besides my Lord, I find myself but ill prepared for that awful combat. The dreadful gloom at a prison is but badly fitted so repentance : it not then a little life be refined me in return for thirty years to contin spirit. and in such acts of charity and benevolence as poverty crams within my reach. : Recommend are, my Lord, in your report to the royal mercy, and let my remaining pains meht be just to that Judge whose mercy is equal to his wrath."- During this short and pathetic speech, he was several times interrupted by tears and emotions, too strong for description. and such as prevailed to excite general sympathy. After a short pause the Recorder addressed him with the usual tenderness ; said that he had a fair and impartial trial, which he himself had acknowledged ; that he was happy to find the court judged a just sense his offense, and advised him to make a public acknowledgment thereof, without any palliation, as the best means his Situation would admit. He said there was no doubt a power yet remaining in which we may dwell, but he advised him not to flatter himself with vain hopes. and now, says the humane Judge, the painful duty only remains to pronounce that awficl sentence which the Laws have provided for offences of so high a nature ---
