THE AFFIDAVIT of Hon. Thomas B. Rickey, to the effect that he cannot get a fair and impartial trial in Ormsby County, and that his life would be in danger if tried in Ormsby, is untruthful in every particular, omitting nothing whatever. The truth is that he is more likely to get a fair and impartial trial in Ormsby than in any other county in the State, and so far as his personal safety is concerned, it is a short ride from Carson City to Reno, where the case would likely be removed, if at all, and anyone in Ormsby desiring to kill him would have better opportunity in Reno than in Carson. In fact, during the greatest excitement following the failure of The State Bank and Trust Company, no one in Ormsby county attempted to hurt a hair of his head, and no one ever heard that any one entertained the idea that personal injury should be visited upon him. That being the case, anyone signing a petition to the effect that he knows the feeling against Mr. Rickey in Ormsby, and that in his opinion he cannot get a fair and impartial trial in Ormsby, would stamp himself as a slanderer of his neighbors. The further truth is that the general feeling in Ormsby is to the effect that it would have been better for the depositors and creditors of the State Bank & Trust Company if Mr. Rickey could have taken hold to marshall its assets. It is evident that he could have done so, and very likely have saved money for himself, and assuredly have saved much for the creditors and depositors, because he knew where the money went and best how to get it back.
The citizens of Ormsby are law-abiding people and no people, anywhere have greater regard for their oaths, and Ormsby is certainly an ideal county in which Mr. Rickey can have a fair and impartial trial.
It is therefore evident that the attorneys for Mr. Rickey, Messrs. Peck and McPike, the latter being fresh from the dirty Thaw case, are simply trying to create a situation, and lay a foundation for an appeal from any order refusing to remove the place of trial, and thus delay.
After that, they will get up other affidavits, and then some.
The further fact is that Mr. Rickey is just as much in danger, and much more in danger in Berkeley and San Francisco than he would be in Carson. The creditors of the State Bank and Trust Company do not want to kill him they want their money, because it is much easier to collect from a live man than from a dead man.
Come on, Tom, and face the music like a man: the whole community will see to your protection. You have transferred all your property through the advice of your attorneys, and you can therefore defeat the execution, should judgment be recovered against you. So you have nothing to lose, if your attorneys are correct in their advice and judgment that your transfer is good against an execution, and that your transfers were made in good faith, for debts actually due and owing, and that you got a fair price for the same. But what did you do with the money that you got for the transfers?
