Counter Attack by McDermott Counsel

Canton, O., Dec. 13. (By the Associated Press) - A counterattack on the state's claim that Don R. Mellett, Canton publisher was murdered in a plot hatched out of bootleggers conspiracy, the defense of Patrick McDermott, one of the alleged murderers, declared in trial court today that the prosecution also was a party to a conspiracy.

Defense counsel contended McDermott was being prosecuted as a result of conspiracy between Prosecutor McClintock the Canton Daily News and Joseph R. Roach, of Chicago, criminal attorney. McClintock, a candidate for congress, was forced to procure indictments against McDermott by reason of his campaign, the defense said they would show.
