Failing to find evidence enough to bind them over on a liquor charge, Judge John L. Cone in Recorder's court Thursday fined Lilly Mae and John Smith, Charlie Hawkins and Beatrice Miller, $17 or 30 days for violating of Section 81 of the city code dealing with morals.
The four were arrested in a Piedmont avenue house Wednesday night and charged with disorderly conduct. According to officers when they entered the yard of the residence, Lilly Mae picked a pint of whiskey from beneath a sunflower plant and emptied it in a shed adjacent to the house.
When the officers reached the shed, the whiskey had disappeared leaving only a pint bottle, they testified. Officers state that they saw a white man flee through the rear door as they entered the yard, but were unable to catch him.
Beatrice Miller, they said had been entertaining the man. The four charged that the police had been tipped off to the house by another girl, who had recently vacated the place as a roomer, after the occupants refused to give her special privileges around the house.
