Amasa E. Walmsley and Thomas J. Walmsley were arraigned for the murder of John Burke, in September last. A motion was made on the part of Amasa E. Walmsley, for a separate trial, which was granted him. The Attorney General, Albert C. Greene, Esq. for the State—Samuel Ames, Peter Pratt, and J. L. Tillinghast, Esqrs. for the prisoner. Jury empanelled: Stephen Steere, foreman, Isaac Lake, William Luther, Pierce Arnold, Nathan Hopkins, Alexander S. Streeter, John Harris, Jr. Albro Hopkins, Peter Place, Thomas Mowry, Benjamin Kimball, and Eseck Esten.
At the time the Court rose this forenoon, the evidence on the part of the Government was not concluded. Sixteen witnesses had been examined.
