FLAGSTAFF - A motion was filed in the Navajo county superior court here today by an assistant county attorney asking that the order of Superior Judge J. F. Crosby, suspending the sentence of from nine to ten years in the state prison, imposed on James L. Black following his conviction last month on manslaughter in connection with the slaying of Charles B. Otey, be set aside and demanding that a bench warrant be issued for the arrest of Black. It is claimed that Judge Crosby's action in sentencing Black and then suspending the sentence is without sanction of the Arizona statutes.
