Tecumseh, Neb., Sept. 14.-On the evening of June 1, 1913, Mrs. Charles W. Sapp, who lives south of this city, was walking along a public street in Tecumseh. She stepped through a defective plank walk, fell to the ground with great force, and her left leg was broken. She brought suit against the city of Tecumseh for damages in the sum of $2,000 for injuries sustained in the fall, and for $76.50, her surgeon's bill. The case was tried in the district court and the lady was given a verdict for $250 which was paid.
A new case has now been brought in the matter in the Johnson county district court. Mrs. Sapp's husband being the complainant. He asks damages in the same amount previously sued for by his wife, together with the surgeon's bill. According to Mr. Sapp's petition his wife was wholly unable to perform her work about the house, care for her poultry, etc., for four months after she was injured. She is not now, or will she ever be, he states, able to perform more than one-half as much work as she was before she was injured. For this reason, and for the anguish both have suffered, claim is made for the damages, as above set out. It is likely the case will come up in the October term of the district court.
