CLARK CHARGED WITH DEATH OF HERBERT SPENCER

LOS ANGELES, June 30. (U.P.)—

David H. Clark, young former deputy district attorney and municipal judge candidate, stood silent today when arraigned before Superior Judge William C. Doran on a murder count.

Clark's refusal to plead resulted in Judge Doran entering a plea of not guilty in behalf of Clark. By pre-arranged stipulation of defense and prosecution, August 3 was set as the date of Clark's trial on a charge of murdering Herbert F. Spencer, editor of a liberal magazine.

Previously the state filed a single information against Clark, naming only the Spencer death. No mention was made of the shooting of Charles Crawford, political boss, who was shot with Spencer last May 20.

LOS ANGELES, June 30. (U.P.)—

The district attorney's office today filed in superior court an information charging David H. Clark, former candidate for municipal court judgeship, with the murder of Herbert F. Spencer, editor of a liberal magazine.

No mention was made of Charles Crawford, big time politician, slain with Spencer last May 20 in the politician's Hollywood office.

Recently at a preliminary hearing Clark was held to the superior court on a double murder charge. Leonard Wilson, of Clark's counsel, denounced the move of the state. He declared that the object in filing the one-count information was to force Clark through two trials.

A bitter legal battle similar to that of Clark's preliminary hearing was forecast when Wilson declared Clark would not plead to the count. This situation, it was said, would force the Judge to enter a not guilty plea in behalf of the defendant.
