Yesterday H. A. Snow caused the arrest of Capt. Fraser of the British ship Nagpore which finished loading grain last evening. The captain gave bonds for his appearance.
The circumstances are substantially as follows: Upon the arrival of the Nagpore Snow piloted her to Portland. The custom is for the pilot who takes the vessel to Portland to take her back here. On Thursday, the 20th inst., Snow got a dispatch asking him to what draft to load her. Snow telegraphed "sixteen feet." and went up the next day, reporting to the captain who said that he had another pilot. Some delay followed, which resulted in the ship's loading to eighteen feet, and starting from Portland the following Monday with that draft. Al. Betts taking her safely through getting here Tuesday afternoon.
Upon the arrival of the vessel Snow presented a bill of $65 to the captain for pilotage of the vessel at 17 feet. The captain paid Betts, and refused to pay Snow, who libelled the vessel. Snow claims that the condition of the tide on the 20th justified him in sending the telegram on that day saying to load her to sixteen feet: that he knows the river and would have been willing and able to take her down drawing eighteen feet on the Monday following as the tide was constantly increasing. The captain claims that the extra two feet that he enabled to load made a difference of over 150 tons to the foot, which cut down his bills for lighterage $400, thus effecting a saving of that amount to the vessel. Upon this fact he, through his agents, bases his refusal to pay the $65 that Snow demands.
Yesterday morning the agents of the vessel deposited $5 with the board of pilot commissioners and gave notice of their intention to present, to-morrow, charges against Snow, alleging want of knowledge of the river in his pilot grounds, and citing the fact that by loading the vessel to eighteen feet they saved $100.
