Mr. McCleary Will Institute a Suit For Malicious Prosecution.

BUTTE, May 22.-P. J. McCleary, who was released by Judge Colman to-day, called at the STANDARD office this evening and asked that he be given the benefit of a statement. He claims that he is the victim of malicious prosecution on the part of Captain Palmer and Tom C. Gray of the Butte & Boston company. Mr. McCleary says that he has engaged an attorney and will proceed against Messrs. Gray and Palmer to recover damages for defamation of character and unlawful imprisonment. As he thinks he has the big end of the club, he is confident of the final outcome of the little triangular bout in which he proposes to engage.
