Attorney Donald Boscoe, authorities at the hospital, and county officials branded as "pure fabrication" stories Higginbotham told of "murder and mistreatment" at the hospital.
They declared the stories were an apparent attempt to escape anticipated imprisonment in San Quentin penitentiary, the United Press reported.
Roscoe questioned Higginbotham and said the man claimed he saw men "killed" at the hospital, but was not definite about the number. Finally admitted "it might have been only two or three."
Higginbotham has been in the county jail for several weeks, having pleaded guilty to forging an $85 check. He is under sentence of 10 months.
Roscoe added Higginbotham never was ordered to San Quentin.
A decision yet to be made will determine whether or not Higginbotham will be removed from jail for observation and possible return to the Stockton hospital where he was under treatment from October 1938 to January, 1939.
Highlight of the Higginbotham stories was "an attendant would put a beer bottle down a man's throat and thus administer a certain medicine. The man would immediately go to sleep and the next day be dead."
District Attorney F. C. Clowdsley, Deputy Coroner Paul Lamb and Dr. Margaret Smythe, superintendent of the hospital, ridiculed the charges.
