Abstract of the Proceedings of the General Assembly, January Session, 1833.

Tuesday Morning, Jan 15.
Mr. Speaker Sprague, took the chair at 10 o'clock, and called the House to order. A quorum appearing in their seats, Mr C. E. Robbins was appointed a committee to wait upon his Excellency the Governor, and the Hon. Senate, and inform them that the House had formed a quorum and were ready to proceed to business. He repaired to the Senate chamber and returned to the House, informed them that the Senate had not formed a quorum. In a few moments the House was informed by a committee from the Senate that they had formed a quorum.
Mr. Shaw moved that his Excellency the Governor and Senate be requested to join this House to receive the proxy votes for General Officers, which being qualified so as to request them to join at 12 o'clock, passed,
Mr. J. L. Tillinghast, after some prefatory remarks introduced resolutions relative to the tariff and the bill reported to Congress by the Committee of Ways and Means, and moved that they lie on the table till afternoon.
The report of the committee on Indian affairs was taken up and read, and the bill accompanying the same. The report states the present number of the Indians to be 6 of the full blood. 14 of about half blood. 158 of less, and 20 who do not belong to the tribe---there are some absent not enumerated--total 193.
The Report was laid on the table.
Adjourned, to three o'clock.
Afternoon. --The House met agreeably to adjournment.
Mr. Pratt presented a communication from Tobias Ross, of the Narragansett tribes of Indians, relating to the Indian affairs---read and laid on the table.
The two Houses, joined in grand committee, and received the proxy votes for Governor, Lieutenant Governor and Senators, and a committee of three from each county, together with the Secretary and Clerks, were appointed a committee to count the votes, when the Grand Committee rose, and the two houses separated.
Mr. Tillinghast moved the consideration of the resolutions presented by him this morning.
The Speaker announced that his excellency the Governor had made a communication by the Secretary. The papers communicated were the proceedings of the Convention of the State of South Carolina Resolutions from the State of Georgia relating to sundry amendments of the Constitution of the United States, and resolutions on the subject of Internal Improvements---Of the state of Illinois on the amendment of the constitution, and of the State of Pennsylvania on the protective system.
Mr. Hazard moved they be referred to a Committee with the resolutions of Mr. Tillinghast.
After some further remarks the resolutions and the communication from the Governor were referred to the following committee : --Messrs. Hazard, Shaw, Tillinghast, Simmons, Potter, King Daniel Greene, Sprague, (Speaker.) D'Wolf and Haule, to report to the House.
And the Assembly adjourned to 11 o'clock this morning
Wednesday, Jan. 16.--House met at the hour adjourned to; and being called to order by the Speaker a number of petitions were received and referred.
On motion of Mr. Robbins, the two Houses joined in Grand Committee and received the report of the Committee appointed to count the votes for Governor, Lieutenant Governor and Senators.
The whole number of votes for Governor were 5,917; of which LUCIUS H. ARNOLD, had 2,870 James Fenner, 2,226 WILLIAM SPRAGUE, 811 and 10 scattering--no choice.. The votes for Lieutenant Governor and Senators, did not vary materially from those of Governor.
Mr. D'Wolf, from the Committee appointed last evening, to whom was referred the resolution presented yesterday by Mr. Tillinghast,reported the same with additional resolutions, all of which were unanimously adopted.
The resolutions on the tariff which passed the House in the morning, were concurred in by the Senate..
The remainder of the time was occupied in disposing of the unfinished business; and the House adjourned to 10 o'clock this morning.
Thursday Morning, Jan. 17.---The House met at 9 o'clock. A petition for an act incorporating a Bank in West Greenwich, was read and referred.
Mr. Hazard moved that the House resolve that it is inexpedient to grant any Bank charter, at this session. Laid on the table.
The following preamble and resolutions were presented by Mr. Tillinghast, and laid on the table
Whereas the test of the Free men voting in any new election that might now be ordered by this House for the choice of Governor, Lieutenant Governor and Senators would be returnable to the General Assembly at the same Session at which the votes which are to be given in the next annual town meetings will be returned, according to the provisions of law, Therefore.
Resolved, as the sense of this House, that by reason of the provision of the law for the next annual election, it has become unnecessary to order, at this session, any new election, to be holden under the provisions of the Act passed in January, 1832. entitled An act in addition to an act entitled an act regulating the manner of admitting freemen and directing the time of electing officers in this State Adjourned to 3 o'clock.
Afternoon, Mr. Tillinghast moved, that the Governor and Senate be invited to join the House, for the election of U. S Senator. Mr. Potter hoped it might postponed till this morning, when, if his feeble health would allow.he would express his views on the subject:- For this short delay he appealed to the magnanimity of the mover. Mr. Tillinghast replied, that this was agreeable he could not resist but he now gave notice, that he should call the subject up this evening
Mr Tillinghast called up his resolution, offered in the morning.for postponing the election of General Officers until April. On motion of Mr. Hazard, and by consent of the mover. The preamble to the resolution was struck out.
The resolution , was opposed by Mr. Wolf After some remarks by Messrs. various, the question was put and passed. almost unanimously 'consequently we shall have no further election for General Officers until the annual town meeting in April.
The petition for a bank in West Greenwich was called up. when' Mr. Hazard re- newed his motion. that it is "inexpedient . to grant any bank charters this session." A long debate ensued. Mr. Simmons and Mr. Wiserman of Coventry,opposed.Mr.Hazard's motion. It was supported by the mover and mr. Tillinghast Mr. D:Wolf spoke forcibly on the subject. -Before the question was taken the House adjourned to 9 o'clock this morning.
Friday morning. Jan. 18. Mr. Tillinghast renewed his motion made yes- terday, that his Excellency the Gover- nor and the Hon. Senate be requested to join the House for the purpose of e lecting a Senator in the Congress of the United States. His plan of Mr. Robbins
was postponed to Saturday Afternoon
A petition was presented from Allen Durfee and others, stating that further and additional evidence had been discovered since the discharge of the Rev. E. K. Avery which in their opinion would be sufficient to convict him of being concerned in the murder of Sarah Maria Cornell, and praying the Assembly to authorize the Governor to issue a proclamation and offer a reward for his apprehension---Read and referred to the committee on the judiciary..
An act passed. granting a Lottery to Paine & Burgan and appointing them Managers.
Adjourned to 9 o'clock morning,
Saturday Morning. Jan. 19.-The house met at 9 o'clock. The Committee to whom was referred the memorial of Allen Durfee and others, were discharged from the consideration, of the same, and the House considered the same. A desultory debate ensued' in which many members took part. The result was the passage of a resolution authorizing his excellency the Governor, to issue a Proclamation, and offer a reward of Three Hundred dollars for the apprehension and delivery of Ephraim K. Avery to the civil authority of the County of Newport, so that he may be held to trial for the alleged murder of Sarah M. Cornell. in Tiverton. " It appeared that the public mind was not satisfied with the legal in- vestigation at Bristol, and the decision of that Court, that within a few days after his discharge by that Court, the Coroner, who called the Jury of inquest on the body of S. M. Cornell, and found a ver- dict that she was willfully murdered, and that she had good cause to suspect that Ephraim K. Avery was concerned in her murder : made a complaint to a Justice of the Peace in the county of Newport. who issued his warrant thereon, which warrant was had before Samuel Randall Esq. one of the Justices of the Supreme Judicial Court, who thereupon issued his warrant to the Sheriff of Bristol-County. requiring him to arrest Avery and deliver him to the Sheriff of Newport County. so that Avery might be held to answer to said charge in that county where. by law he was bound to answer the murder they having been committed in that county. It also appeared that Avery soon after his discharge and, upon the advice of friends either absconded from the state, or was secreted by them, so that the Sheriff of Bristol was unable to find him. It was further stated that since the discharge of Avery,other material evidence had come to light against him. Under these circumstances the Assembly were nearly or quite unanimous in the passage of the resolution.
AFTERNOON Mr Tillinghast now moved his motion that the House request the Governor and Senate to join the House in Grand Committee for the purpose of electing a Senator to the Congress of the U States in the place of Asher Robbins. whose term of service would expire on the third day of March next,
A debate ensued of considerable length in which several members took part.--- The question proposed by Mr. Tillinghast was however taken and determined in the affirmative. Yeas 37 nays 32.
The two houses having joined in grand committee. Mr C Allen nominated Elisha R Pot- ler. Mr Ti linghast Asher Robbins and Mr B Low Dutee J Pearce and the vote being taken and counted it appeared that Asher Rob bins received 41 votes. Elisha R Potter 25 and Dutee J Pearce 12 -and it was declared that Asher Robbins was elected a Senator in Congress from this State, for the term of six years from the third of March next
