The administration has been attacked by the Federalists for permitting Gen. Kearney and Com. Stockton to establish a temporary form of civil government in those portions of the Mexican territory which they had conquered. They (the Feds) urge that in so doing the constitution was violated-that it was placing the Executive over the Legislative. The following proclamation of Gen. Harrison and Com. Perry will shew that Kearney and Stockton have illustrious precedents for their course:-
" Proclamation, by William Henry Harrison, Major General in the service of the United States, commander-in-chief of the Northwestern army, and Oliver Hazard Perry, Captain in the Navy, and commanding the fleet of the United States on Lake Erie.
Whereas, by the combined operations of the land and naval forces under our command, those of the enemy within the upper district of Upper Canada have been captured or destroyed, and the said district is now in the quiet possession of our troops, it becomes necessary to provide for its government; therefore we do hereby proclaim and make known that the rights and privileges of the inhabitants, and the laws and customs of the country, as they existed or were in force at the period of our arrival, shall continue to prevail. All magistrates and other civil officers are to resume the exercise of their functions, previously taking an oath to be faithful to the government of the United States, as long as they shall be in possession of the country.
" The authority of all militia commissions is suspended in said districts, and the officers required to give their parole in such way as the officers who may be appointed by the Commanding General to administer the government shall direct.
The inhabitants of said district are promised protection for their persons and property, with the exception of those cases embraced by the proclamation of Gen. Proctor, of the - - ultimo, which is declared to be in force, and the powers therein transferred to the officers appointed to administer the government. Given under our hands and seals, at Sandwich, this 17th October, 1813.
