Land Case Decided by Justice Bevans.
Justice Bevans yesterday heard the case of J. A. McGregor vs. J. A. Smith, a suit for commissions on a land sale in the sum of $50, and rendered a verdict for the plaintiff.
The evidence developed that Mr. McGregor, who lives in Statesboro, had entered into an agreement with Smith to sell a piece of land for which service he was to receive a commission of 5 per cent. of the price brought. Mr. McGregor advertised the property in his paper, and while the "ad" was running, and he was making an effort to sell the property for Smith, the latter sold the land, and refused to pay the commission upon the ground that Mr. McGregor had not made the sale.
Mr. McGregor claimed that, while he did not sell the property himself, his advertising had been instrumental in bringing about the deal. He also proved that a contract with Smith specified he should receive the commission for perfecting or aiding in the sale of the property.
The contract was in evidence. Smith said that he did not know at the time the same was made that it bind him except should McGregor make the sale personally. In view of the evidence and the contract there was nothing to do but find for the plaintiff, which was done, in the amount alleged.
