The constitutionality of a distribution of the surplus revenue among the states was fully discussed when the question was before Congress during Jackson's administration and the decision was overwhelmingly in the affirmative. Now that the proposal is revived the question of its constitutionality is revived with it, and presented as though it was still an open one. Those who can find no other objection to the distribution plan, and yet dislike it for its novelty, are inclined to base their opposition on constitutional grounds. If its expediency once is admitted, however, we are confident that the plan will be adopted, for, unless the Constitution has been misconstrued from the beginning, the Government has full power to distribute the surplus as proposed.
