GOVERNOR SMALL
GOES ON TRIAL

Charged With Conspiracy
to
Embezzle State Funds When
He Was Illinois Treasurer.

WAUKEGAN, Ill, April 24.- Governor
Len Small of Illinois, went on trial
today charged with conspiracy to em-
bezzle state funds while he was state
treasurer. Tonight one juror had been
tentatively accepted by both sides, one
tentatively passed by the defense and
twenty two dismissed for cause.

Governor Small, his son, Leslie, and
several friends attended the opening
session. Judge Clair C. Edwards, an-
nounced today it would not be neces-
sary for the Governor to remain in
court throughout the trial.

Theodore Goldschmidt, local whole-
sale fruit dealer, is the juror tenative-
ly passed by both sides, the case start-
ed July 20, 1921 when the Sangamon
county grand jury at Springfield re-
turned the indictments against the
Governor.

During the questioning of the pros-
pective jurors, Frank Popp, a young
farmer by the state if he had a fixed
opinion, pointed to the governor and
said:

"You want to stick that guy in don't
you?"
