Trial of Phil Breedlove, charged with the murder of Rex Samples in this city on February 5, 1922, proceeds slowly in Department 1 of the superior court and up to the time of going to press, a jury had not been selected after nearly two days spent in the examination of prospective jurors. The selection of a jury is long drawn out, due to the number and length of the questions asked by the prosecution and defense.
Attorney Seymour, for the defense, asked questions to ascertain if the prospective juror was opposed to emotional insanity as a justification for murder, also intimated the introduction of the "unwritten law" as part of the defense, inquiring of jurymen if they believed in the sanctity of the home and that the killing of one who invaded the home or disrupted the home life of a family is justifiable under certain conditions.
Few Spectators
The case has attracted little attention, there being no spectators in the court either today or yesterday, except members of the jury panel who were awaiting their turn, and attaches of the court. This afternoon, indications were that it would probably be tomorrow morning before 12 men to hear the case are finally selected.
