Copy of a letter from the captain of the ship General Eaton, to his owner in Portsmouth, dated Calais, 17th May.
"Since I wrote you on the 1st January, enclosing protests, and my letter of the 16th January relative to my capture and being conducted into this port on the 6th Dec. last--nothing has transpired, either for clearing or condemning the ship Gen. Eaton, as the emperor has ordered all cases of captures since the first of November last, to be suspended in the council of prizes, and cases of this nature no doubt will be some time before they are brought forward, and perhaps at last be condemned.
"The ship Union, of Providence, that compromised some months ago, is cleared as a cartel, to take home the distressed Americans who have fallen victims to the French privateers. The ship America of Philadelphia, from Holland or Germany, captured 17 months ago, and had been compromised for nine months for 150,000 francs, has at last received the emperor's signature to his restoration; compromises are at present not sanctioned in the council of prizes.
"So good a ship as the General Eaton, and in such good order when captured, 'tis enough to make any man's heart ache to see her laid in almost a ruinous condition on a mud bank. Should she be cleared, there will be no end to expenses; and if she is condemned there will be some expenses attending trials, &c.!
Dunkirk, May 25.
"The ship America sailed yesterday. By her I have transmitted a copy of the foregoing."
* Captured under the Berlin and Milan decrees 46 days after the day in which they were falsely said to have been revoked!
