April 14. Ended the Session at the Old Bailey, when John Salisbury, for robbing the Turnpikeman at Smallbury Green, Robert Lane for robbing the reverend Mr. Noble on Mount Pleasant, George Hall and George Best for a Burglary, John Stephens for a Highway Robbery, John Turner for Sheep-stealing, and John Knight for Theft in a Dwelling-House, were condemn'd. One was to be transported for fourteen, 29 for seven Years, two branded, three whipped, and thirty one acquitted; Lord Lemster was found guilty of Manslaughter: It appeared on the Trial that Lord Lemster had at a Masquerade, refused to lend Capt. Grey ten Guineas, with some Rudeness; that Lord Lemster having proposed to Capt. Collingwood to go to Capt. Grey at the Tilt-yard Coffee-House, some Words arose after Supper, and Capt. Grey first violated the Decency of Conversation and gave Lord Lemster the Lie: Lord Lemster then called him Scoundrel, Swords were drawn, but Capt. Collingwood interposing they Sat down again, and seemed to be reconciled. It has when they parted, there was some whispering between Lord Lemster and Capt. Grey in the Passage, and that next Morning Capt. Grey went to Lord Lemster's Lodgings, and soon after went out with him; that while they were walking in Marybone Fields Capt. Grey suddenly turn'd about, and a Duel ensued, in which Capt. Grey received a Wound and dropp'd on his Knee, but rising made another Push at his Antagonist, and then fell dead on his Face. Thomas Ashley, Gardener was found guilty of Perjury in swearing for Godard, at his Trial, that he threw the Jew into a Ditch, threw a Stone at him, broke his Head, and thereby caused the Blood to flow, in Contradiction to what the Jew had sworn that his Head was broke by the Persons that robbed him. Several Witnesses deposed that he was at that Time drunk at a distant Place.
