Henry Kind, who has been in San Francisco testifying in the Capron contest, returned home Thursday. He informs us that the case for the contesting stepdaughters is closed, and that the introduction of evidence on the part of Judge Fitzgerald is now in progress.
On Tuesday Mrs. M. N. Holly testified that Capron had told her of his stepdaughters, Madge, Hattie and Mamie, being in the kitchen, and that he overheard them speaking of how everything had been fixed, and that when stepfather was dead they would have everything they wanted, that they then all clapped their hands and Hattie said, "Oh, don't I wish he was dead now." Capron also told Mrs. Holly that Madge was unprincipled and vicious; that no friends were allowed to see him; that he thought he would have to go to San Jose to live, as his home was not comfortable. Mrs. Holly considered Capron of perfectly sound mind.
O. O. Wallace and G. W. Baker also testified that they had had frequent dealings with Capron, and that they considered him of sound mind.
It is still uncertain when the trial of the case will be finished. Mr. Kind says that Judge Coffey's courtroom is daily crowded with old Eurekans who are taking a deep interest in the proceedings in this important case.
