SHOT WITH A MUSKET.

The Accused Says He Shot Him to Punish Him and Not to Kill.

At about 4 o'clock last evening, at the New Basin toll gate, a difficulty took place between the toll gate keeper, Joseph Touard, and a Dr. Fryer, which terminated in the former receiving two buckshots in his lumbar region from a musket in the hands of the latter. The wound, though painful, is not considered dangerous.

The accused was arrested by Officer J. S. Fields, of the Central Station, and locked up.

The statements in regard to this bloody affair are conflicting. The first statement is to the effect that the two have been living on unfriendly terms for some time past, and yesterday the two met and proceedings were inaugurated by Dr. Fryer striking his opponent in the face with his fist; then leaving him, he went off, armed himself, returned and shot him.

The statement of the accused is to the effect that Touard struck his son, and he called on him for an explanation; when he did so, Touard drew a pistol on him; being unarmed, he procured his musket and fired on him. His intention was to punish him, not to kill him.

The accused is a man sixty-five years of age.
