The first suit brought in this county on an adverse claim to an application for patent for mining claims, was brought yesterday in the district court on the chancery side thereof.
The case is briefly, that Daniel McMaster, superintendent of the Homestake Mining Company, of Deadwood, applied in the Cheyenne Land office for a patent to eight petroleum oil claims, situated near Jenny's stockade, and containing 160 acres. Joseph C. Spencer and Ralph C. Webster, of Deadwood, filed a protest and adverse claim for 120 acres thereof, in the land office, and brought the suit as stated, to determine the right of possession of the lands in controversy, which are said to be worth about $150,000, as the oil is of excellent grade, being superior to the Pennsylvania petroleum. W. W. Corlett represents the claimant and J. C. Baird the adverse claimants.
