Lifts Rent Ban Despite Appeal By Labor Unions

Washington (LPA)—Los Angeles tenants suffered what looked like a fatal blow Aug. 28 in their fight to keep rent control. Federal Judge Burnita Matthews dissolved an injunction which temporarily barred the federal housing expeditor from decontrolling rents in the southern California metropolis and dismissed the case.

Judge Matthews also rejected an application by the Los Angeles Tenants Council to stay action pending an appeal. David Smith, attorney for the council, said he would appeal anyway, but couldn't say exactly how he would go about it.

The Tenants Council said the Los Angeles City Council did not act "in accord with the law" when it voted to end controls. The City Council acted under the new federal rent law which allows local governing bodies to vote decontrol which must be endorsed and put into effect by the federal expeditor.

The Tenants Council, led by the International Association of Machinists, the AFL and CIO, contended that landlord groups were given full and orderly hearings before the City Council but that "jeering and booing" were permitted when tenants testified. In addition, the tenant group charged that announcements were made in advance that the City Council would vote for decontrol.
