Grant's message respecting Utah calls
attention to the dangers likely to arise
during the recess from a conflict of Fed-
eral Territorial authorities with the gen-
eral judicature of the Territory. Evi-
dently it was never intended to intrust
the Territorial Legislature with power to
create a judicature of its own, or increase
the jurisdiction of the Federal Courts.
In both these respects Utah requires
legislation by Congress. The selection
of grand and petit juries must be placed
in the hands of those entirely indepen-
dent of those determined not to enforce
any obnoxious Act of Congress. An Act
should be passed to deprive Territorial
Courts of all power to impede the action
of the Federal Courts. The Act creat-
ing the Territory of Utah provides for
such legislation.
