DISCOVERY MADE IN COMPTON CASE

Little Rock, Ark., Sept. 16.—Former County Judge W. A. Compton, of Pulaski county, who has been a resident of Marianna, Lee county, for the last ten years, has won an important point in the appeal of a felony case to the Supreme Court. He was convicted last spring of having embezzled $100 of school funds as a member of the Marianna school board, and after a hard fought trial and one mistrial, was sentenced to one year in the penitentiary. An appeal was taken to the Supreme Court. Now comes the attorney general and confesses error, admitting that the indictment is fatally defective in failing to mention that the alleged offense was against the peace and dignity of the state, and that it does not allege facts sufficient to give the court jurisdiction. These conditions being true, the attorney general asks that the case be reversed and the indictment quashed. The friends of Judge Compton, who is a son of a former court, and his friends have all the time contended that the alleged offense was largely technical in character.
