One of the cases drawing a large amount of interest at the county court last Wednesday was that of Horace English, negro, of the North Cove section, charged with assault with a deadly weapon. English is alleged to have fired a shotgun that sent buckshot into the chests and heads of James Carson and Portia Smith, negroes, last Sunday night near Walketown as they were returning from church.
Both injured negroes were carried to the Marion General Hospital where they received treatment. Neither was dangerously hurt and both are expected to be fully recovered within a few days.
It was brought out in the trial that English had been drinking, and being somewhat alarmed with current stories of the hyena said to prowl in his neighborhood, carried a shotgun with him as he went out into the night. English testified that his gun was discharged accidentally and wounded the two negroes a hundred yards farther down the road.
He drew a six months road sentence.
The court heard and disposed of a number of other cases during its two day session this week. Several cases were found "not guilty", a few others continued to a later date, and two cases were appealed in addition to the ones disposed of and sentenced.
Clifford Henline, charged with possessing and transporting, was sentenced to six months on county roads suspended upon payment of $25 and costs. Earl Smith, on a similar charge drew a three months road term. Conley Mull, charged with possessing, was also sent to the roads for three months.
Fred Morris, indicted for assault, received a thirty days jail sentence. He gave notice of appeal.
Joe Bruner, Grady Mills and Ed Evans were jointly charged with larceny, and drew the respective judgments: Bruner to show good behavior for six months, Mills six months on the roads, and Evans, who has a police record, was given 12 months on the roads. Several other larceny cases were reverted to the juvenile court as culprits were under sixteen years of age.
