Commonwealth vs. Theodore Lyman. Jr.—This morning, Gen. Theodore Lyman, Jr. was arraigned on an indictment for a libel against Hon. Daniel Webster; The indictment contained two counts, to which the defendant pleaded not guilty, and moved by his counsel for a continuance to the next term of this Court, in March ensuing. Motion under consideration. Meantime the defendant is ordered to recognize in the sum of $1000 for his appearance from day to day—his own surety being taken therefor.
We learn that the defendant, in his affidavit in support of the above motion, stated, that wishing to give the truth in evidence, it would be necessary to have the testimony of several gentlemen in different States—among them, Hon. W. B. Giles, of Virginia, and His Excellency John Q. Adams, President of the U. States— "and the said Lyman, on oath, further says, that he has good reason to believe that the said John Q. Adams will return to this Commonwealth, and be within the jurisdiction of this Court, by the time aforesaid."
