THAT MINE SPECULATION.
The Case as Presented by Both of the Interested Parties-Was it a Swindle?
In speaking of the Indictment of W. V. Herring, of Medina county, for swindling., the Castroville Anvil says:
"George Kalteyer, of San Antonio, some time since, had Mr. W. V. Herring, of this county, indicted for swindling. It seems as if Kalteyer claims that Herring "salted" a mine and deceived him as to its true value. Kalteyer claims to have purchased the mine on the merit of samples of coal shown him by Mr. Herring, which he claimed to have taken from the mine, but after some search it appears that no coal could be found equal to the sample that was shown Kalteyer. From what we understand of the case, it seems that Mr. Herring is being persecuted rather than prosecuted. We are informed that Herring sold the mine to Kalteyer on these terms: That Kalteyer was to work and operate the mines and pay Herring a royalty on all coal that was taken out, but after sinking a shaft some 80 or 90 feet, and passing through several veins of coal, the project was abandoned and suit instituted as above stated because the coal found was not equal to the sample shown Mr. Kalteyer when he entered into the aforementioned contract. How any intention of or motive for swindling can be shown on the part of Mr. Herring under the circumstances, is what we fail to comprehend."
This is the Anvil's statement, no doubt based upon information received from Mr. Herring and his friends, but, if as Mr. Kalteyer asserts, no such coal can be found in the mines as the sample upon which he was induced to purchase his interest, there appears to be prima facia evidence of deception. Of course the Light merely takes this point without prejudice to the rights and interests of either party.
