Colorado Springs, Colo., March 16.—Legal action in behalf of the striking mill men in Colorado City has been instituted in the district court of El Paso county. It is a general suit to restrict and define the authority of the military forces and to restrain them from infringing upon the personal and property rights of private citizens. The complaint is directed to W. R. Gilbert, sheriff of El Paso county; General John Chase, Colonel Jas. H. Brown, and others. Coroner Law has served a summons upon Sheriff Gilbert. The militia officers declare that while on duty or under arms in the service of the state they cannot be served with legal papers. The coroner has an opinion from a legal authority that a summons of this nature requiring the defendants to answer in twenty days can be served, and he will proceed to do so as soon as possible.
Strike Is Partly Settled.
A partial settlement has been effected in the mill men's strike at Colorado City, which has been on for nearly a month, and on account of which, the state troops were ordered out. One of the features of the settlement is an agreement that the troops be withdrawn at once.
