James A. Kingman has filed a petition in the superior court asking that he be appointed guardian ad litem of Julia Andrews, a person of unsound mind, who is made the defendant in a suit instituted by Enterprise lodge No. 7, I.O.O.F., to quiet title to a lot on Alder street in the city of Walla Walla. Kingman is the son of Julia Andrews and he claims that he is the proper person to represent her in the action commenced. In his petition he alleges among other things that the property in question was owned by Julia Andrews, and that John B. Wilson, who had been duly appointed as her guardian, sold the same under a pretended order of the superior court. That the plaintiff's title to the said property in question was owned by sale made by Wilson, and it being to the interest of Wilson that the sale be held valid he has failed to interpose any defense in the suit. It is to the interest of Julia Andrews that the sale be declared void, and as her interests and those of Wilson conflict, the said Wilson is not a proper person to defend in behalf of his ward. He also alleges that Wilson, while acting in his capacity of guardian has incurred large and useless expense to the estate without first obtaining an order from the court to do so. That he has under pretended orders of the court converted all the real estate of Julia Andrews into money, and by expending large sums of said money in the management of the estate has materially reduced the value of the same. He further alleges that Wilson is now a resident of Seattle and that he has left the management of his mother's estate to agents.
