SCHWEER ESTATE IN THE COURTS

Roy Benjamin Brought Suit Today In Court to Establish Right to Possession of Property.

A legal struggle which involves the estate of the late Barbara Schweer who, until her death a few months ago, lived at 619 Timea street, has been begun in the district court here by attorneys for Roy Benjamin, a nephew of the deceased, who seeks to obtain possession of the property as against W. T. Benjamin, J. F. Benjamin, Louis Benjamin, Mrs. Malinda Bonn and W. J. Westerfield. Ira Anderson, administrator of the estate, is also named as a defendant.

Mrs. Schweer was the widow of William Schweer, who was at one time the owner and manager of a box factory on South Fifth street. At the time of her death she was possessed of property valued at about $5,000. This property is in the form of a residence on Timea street and money and credits to the sum of nearly $1,000.

She died failing to make a conveyance or will providing for the disposing of the property, and, according to the petition placed on file here today, numerous claimants have come forward.

Roy Benjamin sets out that he lived with his aunt for a number of years and was always regarded as a son. He went west several years ago, but returned to care for his aunt at her request. It is set out by his attorneys that it was the aunt's intention to bequeath the property to him, as she had no lineal descendents.

The plaintiff lives in Fort Madison, and is a fireman on the Santa Fe. The defendants live in Lee county, several of them residing on farms near Donnellson.
