He owns and resides in the house situated No. 722 Jackson street, and has lately purchased the lot in his immediate rear, on which is situated a spring which has been used as a public convenience for several years. Mr. Lanier complains that Thomas White cursed and abused both him and his wife because he had fenced in his spring and refused them further privileges to its use. He made a complaint before the Mayor, but owing to some informality in the papers and the absence of certain witnesses, the case was dismissed yesterday morning. He states, besides, that several planks were torn from his fence and some lying near were carried off. From his statement it would seem that he has lately purchased the property whereon the spring is situated; that his neighbors had heretofore enjoyed a kind of community right to its enjoyment and claim his excluding them not only an infringement, but an outrage, and had, therefore, proceeded to extreme measures.
As further threats against him have been made, we are assured the chief of police will protect him, and the mayor will punish the offenders, if they are caught and the above facts proved. Mr. Lanier has certainly the right to exclude any or all persons from intruding on his enclosed premises, however great a hardship it may work for them.
